Terms of Use

The following provisions govern access to and use of this website. Browsing this website confers the status of user and implies full and unreserved acceptance of this legal notice.

The user expressly agrees that access to and use of this website takes place under their sole and exclusive responsibility.

Access to this website is free and does not require subscription or registration. To purchase challenges, registration on the website will be required in order to guarantee correct operation and ensure the proper delivery of purchased goods.

This legal notice may be modified at any time to adapt it to legislative, jurisprudential or technological changes.

Terms of sale

Subject matter and prices

The subject matter of the contract is the user's registration for virtual challenges offered on Victoris. Some challenges also include a physical pack with a commemorative medal.

Prices are shown in euros and include any applicable VAT. Shipping costs, where they apply, are shown before you confirm your order.

Payment method

Payment is processed through the MONEI gateway, which accepts card, Bizum, Apple Pay and Google Pay. Victoris never stores the user's card details: payment is handled entirely by the payment gateway.

Personalisation

Physical medals may include text engraved to the user's choice, specified by the user during the purchase process.

Shipping costs and deferred delivery

Shipping costs are calculated automatically based on the weight of the order and the destination province. Orders that are exclusively digital incur no shipping costs.

Deferred delivery: the order is paid for at the moment you register for the challenge. The physical pack, however, is only prepared and dispatched once the user completes the challenge and clicks the «Finish challenge» button, at which point the shipping address is confirmed. There is no deadline for doing so: the date given at registration is purely indicative.

Withdrawal and warranty

As a consumer, the user has the right to withdraw from the contract within 14 calendar days without giving any reason, by notifying info@victoris.es. The amount will be refunded using the same payment method within a maximum of 14 days.

Registering for a challenge comprises two distinct elements — the service and the physical goods — and the right of withdrawal operates differently for each of them.

The service (your challenge registration). This comprises access to the platform, your bib, the recording of your kilometres, the leaderboard, the coins, the achievements and the certificate. It is provided from the very moment you register, because you expressly request it when you buy. In accordance with article 108.3 of the TRLGDCU (the Spanish consolidated law for the defence of consumers and users), if you withdraw once the service has begun, you will be refunded the amount paid less the proportional part of the service already provided.

The proportional part of the service already provided is calculated on the registration price, in proportion to the kilometres you have recorded in the challenge relative to the total distance of the challenge, up to a maximum of 100%. For example: in a 100 km challenge with a €10 registration, if you have recorded 30 km and you withdraw, you get €7 of the registration back. If you have not recorded a single kilometre, nothing is withheld for the service.

The goods (the medal and the physical pack). In accordance with article 103.c of the TRLGDCU, the right of withdrawal does not apply to medals already engraved with your personalised text, as these are goods made to your specifications. Since engraving only begins when you click "Finish challenge", you may withdraw from the physical part at any time before that moment and you will be refunded in full, including shipping costs if the order has not yet been dispatched.

Warranty: products carry a 3-year legal warranty against lack of conformity, under Spanish Law 11/2022. If a product is faulty or is damaged in transit, it will be replaced at no additional cost to the user.

Victoris is a trade name of GAMUCI MARTÍNEZ DISEÑO Y DESARROLLO S.L., owner of all rights over the content of this website. The design, content, texts, photographs, images, trademarks, trade names, page structure and source code are the property of GAMUCI MARTÍNEZ DISEÑO Y DESARROLLO S.L.

Under no circumstances may the user copy, modify, distribute, transmit, reproduce, publish, assign or sell the aforementioned elements without the express written authorisation of their owner.

Users shall be liable for any damages Victoris may suffer as a result of failure to comply with current intellectual property regulations.

Third-party trademarks

Garmin, Strava, Coros, Apple Watch and Polar are trademarks of their respective owners. Victoris is not associated with them, nor integrated with their services: it merely lets you manually import .gpx files that you yourself export from those apps or devices.

Referral program

  • Every registered user receives a personal invitation link.
  • Anyone who signs up through that link receives a welcome discount code.
  • When that friend completes their first paid purchase, the user who invited them receives their own discount code in turn.
  • Nature of the reward: these are personal discount codes for a fixed amount in euros (currently €5), redeemable only against an order on victoris.es. They are not money, they cannot be exchanged for cash and they are not transferable.
  • Expiry: 90 days from issue.
  • Not cumulative: only one code per order.
  • Misuse: self-invitation, duplicate accounts or any other fraudulent use of the programme will void the codes and may lead to the account being closed.
  • Victoris reserves the right to change the amounts or end the programme at any time, always honouring codes that have already been issued and have not expired.

Coin collection

  • Coins are not bought or sold: they are earned by reaching certain milestones within Victoris.
  • They have no monetary value, they grant no discounts or any other financial advantage, and they cannot be exchanged for money or transferred between users. Their value is purely symbolic and collectable.
  • Each achievement is granted only once per user.
  • Delivery: when a physical coin is unlocked, it joins a shipping queue and travels at no additional cost with the user's next order, with a maximum of one coin per shipment. Coins are never shipped on their own, and there is no need to claim them.
  • Gold coins are seasonal and produced in limited runs: once the corresponding season closes, they are no longer available.
  • Some achievements (such as Chronicler) are granted manually by the Victoris editorial team.
  • The kilometres that give rise to achievements are recorded by the user's own declaration. Victoris may revoke at any time any achievement obtained fraudulently.

Applicable jurisdiction

Any relationship between the user and Victoris shall be governed by and interpreted in accordance with Spanish law. In the event of a dispute, the parties shall submit to the Courts and Tribunals that are competent under the law. Where the user is a consumer, the competent court shall be the one for their place of residence, and this clause shall not limit that right.
